Just before his untimely passing, in a dissent from the Obergefell v. Hodges case declaring homosexual marriage a right, Scalia penned an important warning every American needs to read.
From CNS News:
Here is an excerpt of a key passage from Scalia’s decision:
I write separately to call attention to this Court’s threat to American democracy.
……..It is of overwhelming importance, however, who it is that rules me. Today’s decree says that my Ruler, and the Ruler of 320 million Americans coast-to-coast, is a majority of the nine lawyers on the Supreme Court. The opinion in these cases is the furthest extension in fact—and the furthest extension one can even imagine—of the Court’s claimed power to create “liberties” that the Constitution and its Amendments neglect to mention. This practice of constitutional revision by an unelected committee of nine, always accompanied (as it is today) by extravagant praise of liberty, robs the People of the most important liberty they asserted in the Declaration of Independence and won in the Revolution of 1776: the freedom to govern themselves.”
Always an advocate for gun rights, the second amendment and conservatives, he wrote important decision in the DC vs Heller 2008 case. Because of him, the 5/4 vote of the supreme court ruled that the constitution specifically protects individual rights to own and use personal firearms. This decision obliterated a ban on handgun storage and possession that was decades old.
“Undoubtedly some think that the Second Amendment is outmoded in a society where our standing army is the pride of our nation, where well-trained police forces provide personal security, and where gun violence is a serious problem. That is perhaps debatable, but what is not debatable is that it is not the role of this Court to pronounce the Second Amendment extinct.”
Appointed by President Reagan, Scalia served as Justice for over 3 decades. Throughout his tenure as Justice of the Supreme Court, he was known to be an outspoken and controversial fighter for conservative Americans and for the Constitution.
Alan Dershowitz is quoted as saying, “Love him or hate him, Antonin Scalia left his mark on American law.
He did not respect precedent, famously saying that he swore an oath to the constitution and not to the previous justices who established wrong precedents.
Scalia was found dead while on a hunting trip at Texas’ Cibolo Creek ranch where he planned to hunt with a few local residents. He did not participate in the afternoon hunt on Friday, but was in great spirits at the lakeside dinner. He was observed to be happy and upbeat. He was found by the owner of the ranch the next morning when he did not appear for the morning nor the noon meal. He appeared peaceful and undisturbed, and the family has waived the option of an autopsy, revealing that he suffered from several medical issues, including heart problems.
During his terms as president, Obama has already appointed two Supreme Court members. A third appointment by the current president could result in an increasingly uphill battle for advocates of the Second Amendment. This increases the already critical importance of the upcoming election. The next president could potentially appoint as many as three new Justices because of the age and health of those presently seated.
